You have been a dedicated employee for many years with a proven track record but suddenly find yourself in a situation where your employer has terminated your employment. The reasons could range anywhere from allegations of wrongdoing on your part where the employer believes it has "just cause" to let you go or simply that you have worked for the company for a long time and 'it is time' - often referred to as "golden handshake". Alternatively, it could be the result of a corporate restructuring and the position you have held is no longer relevant, is becoming automated or is being rolled into another position with the end game of the employer being to reduce the number of employees and therefore its payroll. Whatever the reason might be, an employer does not have to keep an employee indefinitely. An employer is entitled to let an employee go at any time no matter how dedicated that employee has been or how long that employee has served the employer. The caveat here is that the employer must provide adequate notice to the employee so that he or she has sufficient time to make other employment/income producing arrangements. In lieu of notice, employers will often choose to extend a package such that the employee is provided a set date where they will no longer be required to work for the company but will enjoy a salary continuance and perhaps some of the extended benefits for a set period of time. The question becomes, what is a reasonable period of time for which that particular employee ought to be provided a salary continuance? And this is where Fox Law can assist.
